Students of the law will be familiar with the case of Associated Provincial Picture Houses Limited v Wednesbury Corporation [1948] 1 KB 223, which was all about whether a local authority could prevent under 15s from attending cinematograph theatres (cinemas to you and me) on a Sunday. We are not told what the naughty under 15 kids had done to deserve such a ban (surely Law Kid wouldn’t have behaved in such a way, whatever it was) and, just like cases involving either snails in bottles or smokeballs, from a legal perspective the facts aren’t so important. What is important is that this case laid down the standard of unreasonableness a public body would have to meet for its decision to be quashed on a judicial review, viz: that the decision was so unreasonable that no reasonable authority could have decided it that way.
